GENERAL TERMS AND CONDITIONS

1. General Information, Formation of the Contract Between the Parties
1.1. These General Terms and Conditions (hereinafter: GTC) apply to all products available for order in the online store (hereinafter: Webshop) accessible through https://www.freshpress.hu operated by BLTN Invest Kft. (hereinafter: Service Provider). These GTC apply to all electronic commerce services provided within Hungary via the Webshop.
1.2. "Customer" refers to any natural person placing an order in the Webshop. The term includes consumers. A consumer is a natural person acting outside the scope of their profession, independent occupation, or business activity, as defined in the Hungarian Civil Code (Act V of 2013, hereinafter: Civil Code).
1.3. Purchases in the Webshop are governed by applicable Hungarian laws, in particular the Civil Code, Act CVIII of 2001 on certain issues of electronic commerce and information society services, and Government Decree 45/2014 (II. 26.) on detailed rules of contracts between consumers and businesses.
1.4. Purchases in the Webshop are made by submitting an order electronically in the manner specified in these GTC.
1.5. The Service Provider is not responsible for fulfilling an order if the product becomes unavailable; the Service Provider may refuse the order.
1.6. The contract between the parties is formed when the Customer accepts the GTC and the Service Provider confirms the order as per the GTC. If the Customer does not accept the GTC, they cannot use the Webshop services, register, or submit orders.
1.7. The concluded contract is considered to be in writing. The contract data stored in writing matches the data provided during the order. The language of the contract and communication is Hungarian.
1.8. Minors or legally incapacitated persons may only use the Website services with the consent of their legal representative.
1.9. The Service Provider does not maintain a code of conduct under Act XLVII of 2008 on the prohibition of unfair commercial practices against consumers.
1.10. By placing an order and checking the box to accept the GTC, the Customer acknowledges and agrees to be bound by these GTC.
1.11. The Service Provider informs that the products offered are food items, and their sale is conducted in accordance with the relevant legislation.
1.12. The Service Provider is obliged to indicate the exact date of product quality preservation. Products may be consumed within their indicated shelf life.
1.13. The Service Provider informs the Customer that all products must be stored in a refrigerator to preserve quality.

3. Orders
3.1. The Website provides an online ordering option. Products are organized into categories. Displayed images are photographs and may differ depending on the Customer’s screen.
3.2. Registration is generally not required but may be necessary for certain services. A password is required during registration.
3.3. Required order data: name, email address, phone number, billing address, shipping address, delivery method, discount code, message, company name and tax number if applicable. By checking the boxes, the Customer accepts the GTC and Privacy Policy.
3.4. The Customer is solely responsible for the accuracy of the provided data. The Service Provider is not liable for issues arising from incorrect data.
3.5. Input errors can be corrected by modifying the shopping cart content.
3.6. Product details are available on the respective product page. The Service Provider does not sell defective or poor-quality products.
3.7. Prices displayed next to products are in Hungarian Forints and include VAT. Shipping costs are shown separately.
3.8. Product prices on the Website may change; modifications take effect upon display on the Website.
3.9. In case of incorrect pricing, the Service Provider is not obliged to sell the product at the incorrect price but may offer delivery at the correct price.
3.10. Orders can only be accepted if all required data is provided.
3.11. Order process:

3.12. Placing an order does not itself create a contract; the Service Provider must confirm the order.
3.13. The Service Provider reserves the right to change promotional offers without prior notice, limit the availability of specific promotions, or modify the start and end dates of advertised promotions. The Service Provider assumes no legal liability for such changes.
3.14. The Service Provider reserves the right to reject any order. If an order is modified or canceled, the Customer will be contacted via the email and/or billing address/phone number provided during order placement. The Service Provider may also limit the quantity of a single item delivered to one postal address.
4. Payment and Delivery Terms
4.1. The Customer can pay the purchase price via:
- Online card payment on the Website (Visa, Visa Electron, Visa Debit, Visa Delta, MasterCard, Maestro)
4.2. Online card payment is provided through an electronic system operated by a payment service provider contracted by the Service Provider. The option is provided by Revolut (https://www.revolut.com/privacy-policy/). Payment is subject to the rules of the payment provider, card company, card issuer, and financial institution. The Service Provider does not handle Customer card data.
4.3. For card payments, the Service Provider places a reservation on the total order amount, including shipping and customs fees if applicable, and charges the account after assembling and dispatching the package. The Customer must confirm the card used is theirs or used with permission from the card owner. If payment authorization is refused by the card issuer, the Service Provider is not liable for delayed or failed delivery.
4.4. All card transactions are processed via a secure online payment gateway using SSL technology.
4.5. Payment is considered completed when the amount reaches the Service Provider’s bank account.
4.6. If the Customer’s card currency differs from the payment currency, the final amount is calculated using the exchange rate applied by the Customer’s bank/provider on the day of payment.
4.7. The Service Provider may refuse an order if payment authorization or reservation cannot be confirmed, if delivery restrictions apply, or if the item is unavailable in sellable condition.
4.8. The Service Provider issues an electronic invoice, sent to the Customer within 5 business days after payment.
4.9. Delivery fees within Hungary:
- GLS courier service or Wolt (Budapest). Specific fees apply as described in original GTC.
4.10. Delivery methods:
- Home delivery via GLS (Hungary)
- Home delivery via Wolt (Budapest)
4.11. Delivery is possible to any address in Hungary. Delivery address may differ from billing address. It should be where the Customer is likely present at the expected delivery time.
4.12. Delivery usually takes 2–4 business days within Hungary if the product is in stock. During peak periods, delivery may take 5–6 business days.
4.13. Deliveries occur on business days between 8:00 and 17:00. Customers can contact the courier for more precise timing.
4.14. Upon delivery, the Customer must check the package for damage, verify its contents with the courier, and sign a report. Claims for missing items after this cannot be accepted.
4.15. Costs for failed deliveries due to Customer error are borne by the Customer. Repeated failed deliveries may result in order restrictions.
4.16. GLS provides insurance up to HUF 50,000 per package until delivery.
5. Warranty and Product Guarantee
5.1. Warranty claims are governed by the Civil Code and Government Decree 373/2021 (VI. 30.) on contracts for the sale of goods and digital services.
- The Service Provider does not accept complaints beyond the product’s shelf life. Customers must report complaints within the shelf life.
- Hot food products must be consumed immediately after heating. The Service Provider is not liable for repeated heating affecting quality or safety.
5.1.1. Warranty
- Customers may claim warranty for defective performance per the Civil Code.
- They may request repair, replacement, proportional price reduction, or, if applicable, rescind the contract, depending on the circumstances. Minor defects do not justify rescission.
- Warranty claims must be reported immediately but no later than two months from discovery. Consumers have a two-year limitation period from contract fulfillment; non-consumers have a one-year limitation.
- Warranty claims must be documented, and the Service Provider must maintain a record and provide a copy to the Customer.
- Repairs or replacements should be completed within 15 days; the Customer must be informed if this is exceeded.
5.1.2. Product Guarantee
- Customers who are consumers may enforce product guarantees instead of or in addition to warranty claims, requesting repair or replacement.
- A product is defective if it does not meet quality standards at the time of sale or the manufacturer’s specifications.
- Guarantee claims must be made within two years of product release; after this, the right expires.
- Product guarantees must be exercised against the manufacturer or distributor. The Customer must prove the defect.
- The manufacturer is exempt only if they prove the defect was not detectable at the time of release according to current science and technology, or if the defect arises from:
- not producing or selling the product within their business activity, or
- legal or mandatory regulatory requirements, or
- improper behavior by the Customer (e.g., breaking the cold chain).
- The manufacturer/distributor only needs to prove one of these reasons to be exempt.
- Warranty and product guarantee claims cannot be enforced simultaneously for the same defect. If a product guarantee claim is successful, the Customer may enforce warranty claims on the repaired or replaced product against the manufacturer.
5.1.3. How to Submit a Warranty or Guarantee Claim
- The Customer can submit a claim by postal mail or email to the Service Provider. The communication must include:
- Customer name and address
- Product name and purchase price
- Date of purchase
- Date of defect notification
- Description of the defect
- Claim the Customer wants to enforce
6. Withdrawal
6.1. After receiving the product, the Customer must immediately check its content, condition, and quality and notify the Service Provider without delay if anything is missing or any discrepancies are found.
6.2. The Service Provider informs Customers that for products available in the Webshop, the Customer cannot exercise the right of withdrawal under Government Decree 29 § (1) d) because these are perishable goods or goods that maintain their quality only for a short period.
7. Complaint Handling
7.1. Customers can submit complaints using the contact details under Section 2. Complaint handling by the Service Provider is free of charge.
7.2. Oral complaints: The Service Provider investigates immediately and resolves if possible. If immediate resolution is not possible, a record is made, a copy is given to the Customer, and a justified reply is sent within 30 days.
7.3. Written complaints: The Service Provider sends a written response within 30 days of receipt, including electronic notification if requested.
7.4. Legal remedies: If a consumer dispute is not resolved, the Customer may contact their local consumer protection authority, conciliation body, or online dispute resolution platform:
8. Data Protection
- The Service Provider handles all personal data confidentially and uses it solely for purposes specified in the Privacy Policy on the Website. Data processing complies with applicable data protection laws.
9. Closing Provisions
9.1. The Website provides an adequate security level, but it is recommended to use antivirus and anti-spyware software and keep systems updated.
9.2. The Service Provider is not liable for damages arising from the use of the Website. The Customer is responsible for protecting their computer and data.
9.3. Transmitting, publishing, or sharing illegal content is prohibited. The Service Provider reserves the right to delete uploaded content.
9.4. For issues not covered in the GTC, the Civil Code and other applicable Hungarian laws apply.
